Terms of Service

These Terms govern use of the Turtles Egg Marketing application ("the Service"), operated by Turtles Egg ("we"). By creating an account or using the Service you agree to them. If you use the Service on behalf of a company, you agree on that company's behalf.

1. What the Service is

The Service is a social-media planning and publishing tool: it helps teams draft content (with optional AI assistance), review and approve it, schedule it, publish it to social platforms the user has connected, and report on how it performed.

2. Accounts

• Accounts are provisioned by a workspace administrator. Keep your credentials confidential; you are responsible for activity under your account.
• You must have the authority to connect any social account you connect, and to publish the content you approve to it.

3. Your content

• You own the content you create and upload. You grant us only the license needed to operate the Service: to store your content, process it (including AI-assisted drafting you request), and transmit it to the platforms you direct us to publish to.
• You are responsible for the content you approve for publishing -- including having the rights to any media, and complying with disclosure rules that apply to your marketing.

4. Acceptable use

You agree not to use the Service to:

• publish content that is unlawful, infringing, deceptive, or that violates the rules of the platform it is published to;
• send spam or unsolicited bulk messages;
• attempt to access other workspaces' data, probe or disrupt the Service, or misuse credentials;
• resell or sublicense the Service without our written agreement.

5. Connected platforms

Publishing depends on third-party platforms (YouTube, TikTok, Instagram, Facebook, Pinterest, LinkedIn, Reddit). Their availability, APIs, and policies are outside our control, and your use of each platform remains governed by that platform's own terms.

6. AI-assisted drafting

AI-drafted captions are suggestions. A person in your workspace reviews and approves content before it publishes, and you are responsible for what you approve. We do not guarantee that AI drafts are accurate, original, or suitable for a given platform.

7. Availability and changes

We may add, change, or remove features, and may suspend the Service for maintenance. We may suspend or terminate accounts that violate these Terms. You may stop using the Service and disconnect your platforms at any time; disconnecting deletes stored platform tokens.

8. Disclaimers

The Service is provided "as is" and "as available", without warranties of any kind, express or implied, including fitness for a particular purpose and non-infringement. We do not warrant that publishing will be uninterrupted or error-free, or that any platform will accept or keep any given post.

9. Limitation of liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenues, or data, arising from your use of the Service. Our total liability for any claim relating to the Service is limited to the greater of USD $100 or the amount you paid us for the Service in the 12 months before the claim.

10. Indemnity

You will indemnify us against third-party claims arising from content you publish through the Service or your breach of these Terms.

11. Governing law

These Terms are governed by the laws of the State of Florida, USA, excluding its conflict of law rules. Disputes will be resolved in the state or federal courts located in Collier County, Florida.

12. Changes to these Terms

If these Terms change materially we will update this page and its effective date, and signed-in users will be notified in the app. Continued use after changes take effect constitutes acceptance.
